Just What is a Tax Lien? How to Invest in Tax Liens – The Basics

A tax lien, just as any other lien, is a security interest granted over someone’s property to ensure payment on an obligation is made.

Local cities and counties all rely on property taxes to fund their police and fire departments, parks, and vital government services for the general public.  They use their legislative powers to ensure taxes are paid once, twice or even four times a year on all property they deem taxable – most land, houses, and even personal property.  If those taxes are not paid when due, the local jurisdiction creates a tax lien on the property that carries rights to enforce payment through foreclosure or other means.  These tax liens can then be sold to private investors who will have the same rights to enforce payment as the local jurisdiction.

In the year 300 B.C., the Roman Republic began an incredible expansion of their empire through trade and conquest.  Their rapidly increasing territory put demands on the Roman government to raise funds for their army and growing bureaucracy.  Taxes were levied on land, livestock and houses at a nominal 1-2% rate much as they are still applied in the modern world.  They were originally collected by tax administrators near the end of harvest time each year. One of the great things about tax lien investing is that there really are no holding costs to your investment until your ready to file and get the deed to the property. In fact, you are the one that gets to sit back and get paid for a change. The only additional funds you will need to put toward your tax lien certificates when you invest in tax liens is to purchase additional subsequent liens that are only offered to you.  Moreover, those subsequent investments earn the full statutory rate – 18 to 24% in some states!

Finding a Tax Lien Attorney

Finding the right tax lien attorney for your tax lien foreclosure or tax lien quiet title action is one of the most important steps to undertake after your initial tax lien or tax certificate investment.  The three most important factors I place when I’m looking for a new foreclosure or quiet title attorney are (1) experience, (2) efficiency and (3) pricing.


Experience

My first rule in hiring a lawyer – do not hire anyone that has never handled a tax lien foreclosure or tax lien quiet title. Period!  And, be careful with attorneys who have handled only a few cases or have only handled regular mortgage foreclosures and other real estate actions.  Tax lien investing is a niche market both for real estate investors as well as real estate attorneys.  There are many good attorneys out there that have handled hundreds if not thousands of tax lien legal actions and you should reach out to your fellow investors to find them.
